MindMyElder is an online platform designed to help families and older adults find trusted, non-medical, in-home companionship, and to help companions connect with families seeking presence, support, and reassurance at home.

By accessing or using the MindMyElder website, platform, or related services (collectively, the "Platform"), you agree to be bound by these Terms & Conditions, which include our Terms of Service, and by all applicable laws and regulations.

If you do not agree with these Terms, please do not use the Platform.

1Platform Role & Scope

MindMyElder is an online platform that facilitates connections between individuals or families seeking non-medical, in-home companionship ("Families") and independent individuals offering companionship services ("Companions").

MindMyElder does not provide care services, medical services, nursing, therapy, personal care, or professional assistance of any kind.

MindMyElder is not a party to any agreement, relationship, or arrangement entered into between Families and Companions.

2Nature of Companionship Services

Companionship services offered through the Platform may include:

  • Presence and reassurance in the home
  • Social interaction and conversation
  • Light assistance with daily routines (non-medical)
  • House presence during travel or short absences

Companions do not provide:

  • Medical care, diagnosis, or treatment
  • Nursing or therapeutic services
  • Personal hygiene or physical care
  • Emergency response services

Families are responsible for ensuring that the companionship arrangement meets their personal needs.

3Independent Status of Companions

Companions using the Platform act as independent individuals, not as employees, agents, contractors, or representatives of MindMyElder.

MindMyElder does not:

  • Employ Companions
  • Set wages or rates
  • Control schedules or duties
  • Supervise or manage in-home activities

All arrangements, expectations, and compensation are agreed upon directly between Families and Companions.

MindMyElder does not handle, process, or guarantee payments between Families and Companions unless explicitly stated otherwise.

4User Accounts & Responsibilities

Users are responsible for:

  • Providing accurate and truthful information
  • Maintaining the security of their account
  • Using the Platform respectfully and lawfully

Each user is responsible for their own decisions, communications, and interactions on and off the Platform.

5Safety, Verifications & User Due Diligence

MindMyElder encourages safety-focused practices, including:

  • Profile verifications (such as identity checks)
  • Clear communication of expectations
  • Use of the Platform's secure messaging system

However, MindMyElder does not guarantee the identity, background, conduct, or suitability of any user.

Families and Companions remain responsible for performing their own checks, asking questions, and deciding whether to proceed with any arrangement.

MindMyElder does not conduct ongoing monitoring of user activity or in-home arrangements.

6Insurance & Disclaimer

MindMyElder does not provide insurance coverage for Families or Companions.

Users are encouraged to maintain any insurance they feel is appropriate for their personal situation, including home, health, liability, or travel insurance where applicable.

MindMyElder is not responsible for:

  • Accidents, injuries, or damages occurring during an arrangement
  • Loss, theft, or property damage
  • Disputes or misunderstandings between users

This limitation exists to keep the Platform focused on connection and transparency, rather than control.

7Reviews & Community Feedback

The Platform allows Families and Companions to leave reviews based on their experience.

Reviews should be:

  • Honest and respectful
  • Focused on communication, reliability, and alignment of expectations
  • Free from personal attacks, medical claims, or discriminatory language

MindMyElder may remove reviews that violate these principles.

8Content & Platform Use

Users are responsible for all content they post on the Platform.

MindMyElder reserves the right to remove content that is misleading, unsafe, unlawful, or inconsistent with the Platform's purpose.

9Privacy & Data Protection

Your privacy matters to us.

Personal data is handled in accordance with our Privacy Policy, which forms part of these Terms.

Please review it to understand how data is collected, used, and protected.

10Limitation of Liability

To the maximum extent permitted by law, MindMyElder shall not be liable for indirect, incidental, or consequential damages arising from use of the Platform.

Nothing in these Terms limits rights that cannot be excluded under applicable law.

MindMyElder shall not be liable for events occurring offline or outside the Platform, including in-home interactions.

To the maximum extent permitted by law, MindMyElder's liability is limited to the functioning of the online Platform itself and does not extend to user conduct, communications, or arrangements, whether online or offline.

We may update these Terms from time to time to reflect legal, operational, or safety improvements.

Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.

These Terms are governed by the laws applicable to your place of residence, subject to mandatory consumer protection rules.
